Introduction

These Terms of Use ("Terms") govern your use of the OnlyPark website, QR-based parking interfaces, and related digital interactions made available by OnlyPark Pty Ltd (ABN 19 677 432 870) ("OnlyPark", "we", "us", "our") in connection with parking facilities managed by OnlyPark.

By accessing our website, scanning a QR code, registering a vehicle, or otherwise interacting with parking systems used by OnlyPark in the management of parking, you agree to be bound by these Terms.

Relationship to On-Site Terms of Entry

Parking at any site managed by OnlyPark is governed primarily by the Terms of Entry displayed on-site. These Terms:

• Do not replace or override the on-site Terms of Entry
• Apply to your digital interaction with OnlyPark systems only
• Must be read together with:

• The applicable on-site Terms of Entry; and
• The OnlyPark Privacy Policy

If there is any inconsistency, the on-site Terms of Entry prevail.

Scope of Services

OnlyPark manages parking compliance on privately managed land on behalf of landowners, body corporates, asset managers, and other authorised principals.

OnlyPark:

• Does not grant parking rights via its website or QR interfaces
• Does not guarantee parking availability
• Does not operate public parking facilities

Permission to park exists only where granted under the applicable on-site Terms of Entry.

Use of Digital Parking Interfaces

You may be required to use a QR code, online form, or payment interface to:

• Register a vehicle
• Validate a parking authorisation or permit
• Make a parking payment
• Review or manage a parking session

You are responsible for ensuring that:

• The correct vehicle registration is entered
• The correct site and parking area are selected
• All information submitted is accurate and complete

OnlyPark is not responsible for errors arising from incorrect information entered by you.

Use of a digital interface does not constitute confirmation of parking compliance or authorisation unless expressly stated under the applicable on-site Terms of Entry.

Payments

Where Pay-By-QR or other digital payment options are available:

• Payments are processed via secure third-party payment providers
• OnlyPark receives confirmation of payment status and transaction reference information only
• OnlyPark does not store full credit card or banking details

Payment of a parking fee does not override or vary the applicable on-site Terms of Entry unless expressly stated.

Compliance and Enforcement

Failure to comply with the on-site Terms of Entry may result in:

• A Non-Compliance Notice being issued
• Recovery action being taken in accordance with those Terms

Use of a digital interface does not exempt a vehicle from enforcement where parking conditions are breached.

Technology Disclaimer

OnlyPark uses third-party technology platforms to support parking operations. While reasonable efforts are made to ensure system availability:

• Digital systems may be unavailable, delayed, or interrupted
• OnlyPark does not guarantee uninterrupted access to any digital service

System availability does not affect the enforceability of the on-site Terms of Entry.

Privacy

Personal information collected through digital interactions is handled in accordance with the OnlyPark Privacy Policy, available on our website.

Limitation of Liability

To the extent permitted by law:

• OnlyPark is not liable for any indirect or consequential loss arising from your use of digital interfaces
• Nothing in these Terms limits any rights you may have under the Australian Consumer Law (ACL)

Changes to These Terms

OnlyPark may update these Terms from time to time. The current version will be published on our website and will take effect from the date of publication.

Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland.
